COMPETITION TERMS AND CONDITIONS
1. ENTRY CONDITIONS
1.1 This competition is in relation to the computer/video game Human Fall Flat (“Game”).
1.2 The promoter of this competition is Curve Digital Publishing Limited of 3rd Floor, 63 Gee Street London EC1V 3RS. United Kingdom (“Promoter”).
1.3 By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
1.4 There is no fee to enter the competition but all entrants will require subscription to a ‘Steam’ account in order to participate and submit a valid entry. Steam is an online games distribution store and marketplace operated by Valve Corporation with its registered office at 10400 NE 4th St., Bellevue, WA 98004, United States (“Valve”).
1.5 The competition is open to all, except employees of the Promoter (and Valve) and their close relatives and anyone otherwise connected with the organisation or judging of the competition. In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.
1.6 This competition is void where restricted or prohibited by law.
2. THE COMPETITION
2.1 The competition is to design and build a game level compatible with the Game (“Game Level”).
2.2 The best Game Level submitted to Promoter in accordance with these terms and conditions by a certain date will win the Prize as detailed below.
3. HOW TO ENTER
3.1 Once an entrant has designed and built their Game Level, they need to post this onto Valve’s Steam Workshop pages relating to the Game [and send a copy by email to Promoter at firstname.lastname@example.org.
3.2 The competition will run from 10am BST on 25th June 2019 (the “Opening Date”) to 11pm BST on 30th August 2019 (the “Closing Date”) inclusive.
3.3 All competition entries must be received by the Promoter by no later than 11pm BST on the Closing Date. All competition entries received after the Closing Date will not be permitted and are automatically disqualified.
3.4 No responsibility can be accepted for entries not received for whatever reason.
3.5 Multiple entries from the same person are permitted provided they are received before the Closing Date.
3.6 Entries must not:
(a) be based on any existing real world or licensed designs, brands or any third-party intellectual property; and/or
(b) feature anything which is racist, sexist, inflammatory, obscene, discriminatory, or offensive.
4. THE PRIZE AND SELECTING THE WINNER
4.1 The prize will consist of $10,000 dollars in cash that will be wired to the successful entrant’s bank account unless other arrangements for payment are notified by Promoter (“Prize”). The Promoter does not accept liability for any charges/currency conversion costs occurred by the entrant when receiving funds into the entrant’s bank account.
4.2 The Prize will be awarded as follows:
(a) All Game Levels received by the Closing Date will be reviewed by Curve Digital Publishing Ltd, the Publisher of the Game, the Judge.
(b) Following the review, the Judge will select the best Game Level and the winner will be announced within two months of the Closing Date (the “Announcement Date”).
4.3 The decision of the Judge is final.
4.4 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 28 of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
4.5 The winning Game Level may be launched by Promoter as a commercial offering to consumers.
4.6 The prize is not negotiable or transferable.
5. OWNERSHIP OF ENTRIES AND PUBLICITY
5.1 Each entrant warrants and undertakes that the competition entry they submit is original to them and does not infringe the rights (including any intellectual property rights) of any third party.
5.2 By submitting the competition entry and any accompanying material, each entrant agrees to:
(a) assign to the Promoter all of their intellectual property rights (including any copyright) with full title guarantee; and
(b) waive all moral rights,
in and to the competition entry and otherwise arising in connection with their entry to which they may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
5.3 The entrant acknowledges and accepts that assignment of the competition entry to Promoter will give Promoter complete discretion to use, modify or deal with the competition entry in any way. The entrant agrees to do such other things and execute such other documents as are reasonably requested by the Promoter in order to allow the Promoter to use and exploit the entry for the permitted purposes and/or to give full effect to the above assignment of intellectual property rights in the entry.
5.4 By submitting an entry to the competition, the entrant grants Promoter the right to use their name and county of residence for the sole purpose of identifying the entrant as the author of the entry and/or as a winner of the competition and that any personal information provided by them with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition. Any personal data relating to winners or any other entrants will be used solely in accordance with current applicable protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
6. LIMITATION OF LIABILITY
6.1 Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the competition or by any technical or human error, which may occur in the processing of submissions in the competition.
6.2 Promoter assumes no responsibility for any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay of operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.
6.3 Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to entrant's or any other person's computer related to or resulting from participating downloading materials in the competition.
7.1 The Promoter reserves the right to hold void, suspend, cancel, or amend the competition.
7.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude an entrant from participating in the competition or disqualify an entry that has already been submitted.
7.3 The Promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any other event outside of the promoter’s control or where it becomes necessary to do so. Any changes to the competition will be notified to entrants as soon as possible by the Promoter.
7.4 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
